- If the member purchases a resort membership concurrently with this membership, the resort membership purchase should be based primarily on the attributes of that resort. The Hopaway Holiday programs and travel services should be a secondary consideration. Hopaway Holiday is not a real estate, timeshare or membership campground offering, nor is there any agency or ownership between Hopaway Holiday and its affiliated resorts.
- Hopaway Holiday acts only as a service company to help facilitate the trade of vacation accommodations. All reservations depend upon the availability of units, and requests can only be confirmed if space is available. Therefore, Hopaway Holiday cannot guarantee that a member will receive accommodations.
- Once accommodations are reserved, the fees paid for the accommodations are non-refundable. Trip cancellation insurance is available at time of booking.
- Hopaway Holiday's liability is expressly limited to the amount of fees the member pays for accommodations arranged by Hopaway Holiday. Members are responsible for the payment of all other expenses, including without limitation the costs of transportation to and from accommodations, food, entertainment and personal expenses. Members are also responsible for damages caused by them or their guests while visiting a resort and for the replacement of any items missing from unit after the member's stay.
- Hopaway Holiday shall not have any responsibility or liability for any damages, injuries, losses, accidents, delays or neglect of any person or entity providing accommodations or related services due to any cause whatsoever or arising from your use of the accommodations or services. In the event Hopaway Holiday has confirmed a reservation for a member, and because of fire, storm, earthquake or any other natural disaster or an act of God or other reason beyond Hopaway Holiday's control, the confirmed unit is not available, the member waives any claims against Hopaway Holiday.
- The terms and conditions of membership in the Hopaway Holiday trade program may be changed by Hopaway Holiday from time to time, including without limitation, the benefits, services and discounts offered, the annual fees and other charges, and priorities and procedures for making reservations. Members are notified of program changes on our websites: www.HopawayHoliday.com, and in other notices to members. Representations made other than in these written publications are not binding on Hopaway Holiday. Current publications supersede all prior publications. All discounts and services provided by other than Hopaway Holiday are subject to change without notice.
- Fees, if any, charged by resorts for the use of amenities are determined by each resort. These fees may differ among resorts.
- Membership in the Hopaway Holiday programs may be suspended or terminated by Hopaway Holiday if the member violates rules pertaining to the resort or if the member is abusive toward the resort personnel or Hopaway Holiday personnel.
- Hopaway Holiday's liability for any loss or damage arising out of membership in the Hopaway Holiday Programs is limited to the annual fee paid to Hopaway Holiday by the member and any fees paid to Hopaway Holiday by the member for accommodations arranged by Hopaway Holiday.
- All published resort information has been obtained from the respective resorts, and to the best of Hopaway Holiday's knowledge, it is accurate and complete. Hopaway Holiday is not responsible for errors of commission or omission.
- This agreement shall be governed by the laws of the State of North Carolina, and venue for any action at law or in equity pursuant to this agreement shall be in Moore County, North Carolina.
- Membership in the Hopaway Holiday programs is non-transferable.
- All Hopaway Holiday Program materials are copyrighted and cannot be reproduced in any form by photocopy or other means, without prior written permission from Hopaway Holiday.
- Any representations concerning the Hopaway Holiday Programs are limited to the written materials provided by Hopaway Holiday in the membership kit and on Hopaway Holiday's website and other publications supplied by Hopaway Holiday. Any other representations are not valid or binding upon Hopaway Holiday.
- Hopaway Holiday cannot guarantee fulfillment of a specific request. Hopaway Holiday cannot guarantee that any particular resort will always be a part of the Hopaway Holiday Programs. Space in more popular areas of the country is also limited.
- Taxes, if any, will be collected by the resort upon check-in.
